CertifyMe, a product of Tech99 Innovations Private Limited, serves as a global SaaS-based digital credential platform. We provide institutions with the technology to issue digital certificates, badges, and verifiable credentials to their end users. Please note the following important terms regarding our services:

• No Liability for Data Accuracy: CertifyMe does not create, verify, or certify the accuracy, validity, or authenticity of any information or data included in the certificates, badges, or credentials issued by institutions through our platform. Institutions are solely responsible for the information provided in the credentials.
• End User Responsibility: It is the sole responsibility of end users to verify the accuracy and completeness of the information contained in the credentials they receive. CertifyMe does not hold any accountability for errors, inaccuracies, or omissions in the information provided by the issuing institutions.
• Direct Engagement with Issuing Institutions: For any corrections, updates, or disputes related to the information contained in the credentials, end users must directly contact the respective issuing institution. CertifyMe does not mediate or intervene in such matters.
• No Assertion of Institutional Authority: CertifyMe does not assert, guarantee, or represent the legitimacy, accreditation, or operational authority of any issuing institution.
• Verification Process: CertifyMe provides technology and a platform to facilitate credential verification. The success or failure of the verification process solely depends on the accuracy and completeness of the data provided by the issuing institution.
• Technology Provider Role: CertifyMe operates purely as a technology service provider, offering tools for the creation and verification of credentials. We do not certify, attest to, or guarantee the accuracy or authenticity of any information shared through our platform.
• System Faults or Maintenance: CertifyMe does not hold responsibility for any downtime, disruptions, or unavailability of services due to system faults, maintenance, or technical issues.
• Data Privacy: Data Privacy: CertifyMe adheres to strict data protection practices and does not share personal information with third parties without consent. However, CertifyMe uses third-party services, including Mailgun, AWS, Digital Ocean, HubSpot, and others, to manage user workflows and execute user processes. While CertifyMe takes all reasonable steps to protect user data, it is not liable for any data breaches or unauthorized access to institution-provided data caused by malicious third-party attacks or vulnerabilities in the third-party services we rely on.
• Intellectual Property: All content, software, designs, and trademarks associated with CertifyMe are the property of Tech99 Innovations Private Limited or its licensors. Unauthorized use, reproduction, or distribution is strictly prohibited.
• Limitation of Liability: CertifyMe shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, arising from the use or inability to use our platform, even if advised of the possibility of such damages.
• Force Majeure: CertifyMe shall not be held responsible for any delay or failure to perform its obligations due to events beyond its reasonable control, including natural disasters, acts of war, cyber-attacks, government actions, or power outages.
• Termination of Service: CertifyMe reserves the right to suspend or terminate access to its platform without prior notice for any unauthorized or harmful use of the service.
• Amendments: CertifyMe reserves the right to amend these terms and conditions at its discretion. Users are encouraged to review the terms regularly to stay informed of any updates.
• Jurisdiction: Any disputes arising out of or related to the use of CertifyMe services shall be governed by and construed in accordance with the laws of India, and the courts in Bangalore shall have exclusive jurisdiction.
• Data Deletion and Subscription Termination: CertifyMe reserves the right to delete all data, including but not limited to credentials, metadata, graphics, and other related information, upon the expiration of the customer's subscription term or one year after the purchase of credits, whichever comes earlier. CertifyMe also holds the right to discontinue service to any customer at the end of their current subscription term without providing any reason. Additionally, CertifyMe is not liable for backing up any customer data, and it is the customer's sole responsibility to maintain backups of their data. If a customer fails to make any further payments or exits the platform, CertifyMe retains the right to delete all stored data without prior notice.
• Account Security: Users are responsible for maintaining the confidentiality of their account credentials (username, password, etc.). CertifyMe is not liable for any unauthorized access or use of your account resulting from a failure to secure your login information.
• Prohibited Uses: Users agree not to use CertifyMe's platform for any unlawful purposes or in any manner that could damage, disable, overburden, or impair the platform. This includes but is not limited to unauthorized access, data scraping, reverse engineering, or exploiting the platform for illegal activities.
• Third-Party Services: CertifyMe may integrate with third-party services or provide links to third-party websites. CertifyMe is not responsible for the content, functionality, or privacy practices of these third-party services or sites. Users are encouraged to review the privacy policies and terms of use of such third-party services.
• Subscription Fees: Users agree to pay all applicable subscription fees for accessing CertifyMe’s services. Subscription fees are subject to change, and CertifyMe will notify users in advance of any such changes. If a user fails to pay the applicable fees, CertifyMe may suspend or terminate their account.
• Service Availability: CertifyMe strives to provide 99.9% uptime availability for its services, but does not guarantee uninterrupted access to the platform. Users acknowledge that service interruptions may occur for maintenance, upgrades, or unforeseen technical issues.
• Indemnification: Users agree to indemnify, defend, and hold harmless CertifyMe, its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, or expenses arising out of their use of CertifyMe’s services, or their violation of these terms.
• Dispute Resolution: Any disputes arising out of or in connection with the use of CertifyMe’s services will first be attempted to be resolved through negotiation or mediation. If such efforts are unsuccessful, the dispute will be resolved through binding arbitration in Bangalore, India.
• Data Ownership: Customers retain ownership of their data and credentials stored on CertifyMe's platform. CertifyMe only holds a limited, non-exclusive, revocable license to access and use the data for the purpose of providing its services.

By using CertifyMe services, end users and institutions agree to these terms and understand CertifyMe's limited role in credential issuance and verification.
